Raptor Kiwi Studios LLC – Terms of Service
These Terms of Service govern your access to and use of all online galleries, digital downloads, products, and services provided by Raptor Kiwi Studios LLC, including its divisions Raptor Kiwi Studios (family photography), Raptor Fashion Photography, and Screamy Kiwi Horror Photography (“we,” “us,” “our”).
By accessing any gallery, downloading any images, or purchasing any products, you agree to these Terms of Service. If you do not agree, you may not access or use our galleries or services.
1. Copyright & Ownership
All photographs, videos, and digital files are the exclusive property of Raptor Kiwi Studios LLC and are protected by U.S. and international copyright law.
You are purchasing a license for use—not ownership of the images. Unless otherwise specified in writing:
- Copyright always remains with Raptor Kiwi Studios LLC
- Redistribution or resale is prohibited
- Images may not be used for AI model training or similar technologies
- Images may not be altered in a way that misrepresents the photographer’s work
Unauthorized use may result in legal action.
2. Usage Rights & Licensing
Personal Sessions (family, portraits, lifestyle):
Clients receive a personal-use license to download, share on social media, and print for personal use. Commercial use, resale, or heavy editing is prohibited.
Fashion, Editorial & Model Portfolio Sessions:
Models may use images for portfolios, comp cards, castings, and social media. Commercial use requires a separate written license.
Commercial, Designer, or Brand Sessions:
Commercial licensing terms will be defined in the project contract or invoice.
3. Downloading & File Delivery
- Files are delivered through Pixieset or another licensed platform.
- Clients are responsible for backing up downloaded files.
- Expired galleries may require an archival fee for reactivation.
4. Refunds & Exchanges
- All digital downloads are non-refundable.
- Print orders are final.
- Replacement prints are only provided for damaged or defective products reported within 7 days of delivery.
5. Editing, Retouching & Modifications
You may not apply filters, AI edits, or third‑party modifications that alter the artistic style of the photographer. Additional retouching requests may incur fees.
6. Online Gallery Access
Galleries are normally available for 90 days. After expiration, galleries may be archived or permanently deleted. Sharing gallery access with unapproved parties is prohibited.
7. Privacy & Confidentiality
Images containing minors or sensitive content will not be shared publicly without written permission. Clients may request private or password‑protected galleries.
8. Booking Policies
Your session contract includes specific terms regarding retainers, refunds, cancellations, rescheduling, late arrivals, and travel fees. That contract overrides conflicting terms in this document.
9. Liability
Raptor Kiwi Studios LLC is not responsible for:
- Loss or damage due to downloading files
- Color discrepancies from non‑partner print labs
- Electronic failures or corrupted files
- Misuse of images by third parties
10. Prohibited Uses
You may not:
- Sell or license images to third parties
- Use images in defamatory, pornographic, or hateful content
- Enter images into contests without permission
- Claim the work was created by anyone else
11. Payment Terms
Payment requirements, late fees, sales tax, and additional service charges are defined in your contract or invoice.
12. Updates to These Terms
We may update these Terms of Service at any time. Changes take effect once posted.
